Modify Child Custody or Visitation in Alabama

If you already have a court order for child custody or visitation, and you need to make changes, the original order must be modified through the court.


When Modification Is Possible

The court will consider a modification if:

  • There has been a material change in circumstances since the original order was entered, and
  • The proposed change is in the best interest of the child

The process depends on whether both parents agree:

  • If both parents agree, a modified agreement may be submitted to the court for approval.
